The antinomies and their occurrence conditions. A proposal for the normative statements

Abstract

The Legal Theory has not yet developed the study of the antinomies between normative statements which do not posses deontic modalities, for this reason this paper focuses on describing and analysing the notion of antinomies and their conditions of occurrence between these normative statements. In order to undertake this task, P.F. Strawson's notion of inconsistency is used, thereafter different delimiting criteria for antinomies between normative statements are developed and exemplified, and finally those criteria could be linked to antinomies' occurrence conditions. Hence, it is possible to obtain a first proposal capable of contributing to the study of the antinomies among normative statements lacking deontic modalities which exist in the legal systems.
