Involuntary psychiatric hospitalization in Chilean Law: substantive aspects

Abstract

This article provides a doctrinal reconstruction of the substantive regulation of involuntary psychiatric hospitalization in Chilean law following the enactment of Law 21.331 in 2021. It identifies and proposes solutions to some interpretative issues affecting this legislation, which pose obstacles to its implementation by administrative authorities and the clinical teams involved and to its review by the courts of justice.
